SUPPLEMENT TO MICROSOFT TERMS OF USE FOR

AZURE DATA EXPLORER FREE CLUSTER

Thank you for your interest in Azure Data Explorer. We are pleased to offer those who wish to explore the service a free trail cluster of Azure Data Explorer (“Free Cluster”). Your use of this Free Cluster is governed by the Microsoft Terms of Use linked below (“Agreement”) and the terms and conditions of this Supplement, together, which are an agreement between you and Microsoft Corporation (or, based on where you live, one of its affiliates). All capitalized terms used in this Supplement, but not defined herein, shall have the meanings given to them in the Agreement. In the event of any conflict between the Agreement and this Supplement, this Supplement will govern as to your use of the Free Cluster.

BY ACCEPTING THIS AGREEMENT OR USING THE FREE CLUSTER, YOU AGREE TO ALL OF THESE TERMS AND CONSENT TO THE TRANSMISSION OF CERTAIN INFORMATION DURING ACTIVATION OF THE FREE CLUSTER AND USE OF YOUR INFORMATION DURING THE USAGE OF THE FREE CLUSTER. IF YOU DO NOT ACCEPT AND COMPLY WITH THESE TERMS, YOU MAY NOT USE THE FREE CLUSTER.

1. Right to use.
1. Microsoft grants you the right to access and use the Free Cluster at no charge for your commercial or non-commercial use for a period of one year. Microsoft may automatically renew the trial period.
2. You are permitted to have a single Free Cluster.
3. Microsoft may delete this Free Cluster upon one month or more of inactivity (e.g., you have no queries or new data).
4. The Free Cluster can be upgraded at any time to an Azure subscription based Azure Data Explorer cluster.
2. Suspension/termination. You may delete the Free Cluster at any time. We may suspend or delete the Free Cluster if we change or discontinue it pursuant to Section 3 below or if: (1) it is reasonably needed to prevent unauthorized access, abusive or malicious use; (2) you fail to respond to a claim of alleged infringement as set forth under the Agreement within a reasonable time; or (3) you do not abide by or violate any terms of the Agreement.
3. Disclaimer. THE FREE CLUSTER IS PROVIDED "AS-IS," "WITH ALL FAULTS," AND "AS AVAILABLE," AND IS EXCLUDED FROM ALL SERVICE LEVEL AGREEMENTS AND WARRANTIES. The Free Cluster may employ lesser or different privacy and security measures than those typically present in Azure Services. Unless otherwise noted, you should not use the Free Cluster to process Personal Data or other data that is subject to legal or regulatory compliance requirements. The following terms in the DPA  do not apply to this Free Cluster: Processing of Personal Data; GDPR, Data Security, and HIPAA Business Associate. We may change or discontinue the Free Cluster from the service at any time without notice.
4. Entire Agreement. This Supplement and the terms of the Agreement are the entire agreement for the Free Cluster. You understand that by using the Free Cluster, you accept this Supplement and these linked terms:
